Definitions

Girls Gone Growth: Girls Gone Growth, established in Zaandam, the Netherlands, Chamber of Commerce no. 81952643.

Customer: the party with whom Girls Gone Growth has entered into an agreement.

Parties: Girls Gone Growth and the customer together.

Consumer: a customer who is an individual acting for private purposes.

Programs: any paid membership or coaching program offered by Girls Gone Growth.

Applicability

These terms and conditions apply to all quotations, offers, activities, orders, agreements, and deliveries of services or products by or on behalf of Girls Gone Growth.

Parties can deviate from these conditions only if explicitly agreed upon in writing.

The parties expressly exclude the applicability of supplementary and/or deviating general terms and conditions of the customer or third parties.

Prices

All prices used by Girls Gone Growth are in euros, inclusive of VAT, unless expressly stated otherwise or agreed otherwise.

Girls Gone Growth reserves the right to adjust all prices for its products or services, at any time.

The parties agree on a total price for a service provided by Girls Gone Growth. This is always a fixed price, which cannot be deviated from.

Girls Gone Growth has the right to adjust prices annually.

Girls Gone Growth will communicate price adjustments to the customer before the price increase becomes effective.

The consumer has the right to terminate the contract with Girls Gone Growth if they do not agree with the price increase.

Payments and Payment Terms

The customer must maintain financial commitments based on the agreed-upon enrollment terms or payment plans.

Payment terms are considered final deadlines. If the customer has not paid by the last day of the term, they are in default without the need for a reminder.

Girls Gone Growth reserves the right to require immediate payment or adequate security before providing services.

Consequences of Late Payment

If the customer does not pay within the agreed term, Girls Gone Growth is entitled to charge interest at 2% per month for non-commercial transactions and 8% per month for commercial transactions.

When in default, the customer is responsible for all extrajudicial collection costs and may be required to compensate Girls Gone Growth for any damages.

Girls Gone Growth may suspend obligations until payment is fulfilled.

In the event of liquidation, bankruptcy, or suspension of payment by the customer, the claims of Girls Gone Growth are immediately due.

Right of Withdrawal

Due to the digital nature of our Programs, Girls Gone Growth does not offer a right of withdrawal once parties have entered into an agreement.

Intellectual Property

Girls Gone Growth retains all intellectual property rights on all designs, writings, content, and materials provided.

The customer may not copy or share Girls Gone Growth’s intellectual property without prior written permission.

Confidentiality

The customer must keep confidential any information they receive from Girls Gone Growth. This obligation remains in force for the duration of the agreement and for three years after.

Guarantee

Girls Gone Growth’s services are based on best-effort obligations, not results.

Duration of Service Agreement

The agreement between Girls Gone Growth and the customer is entered into for the duration of one year, unless otherwise stated or agreed in writing.

Liability of Girls Gone Growth

Girls Gone Growth is not liable for damages resulting from the use of its Programs. The customer is solely responsible for ensuring compliance with applicable laws.

Termination

Girls Gone Growth reserves the right to terminate the customer’s access to Programs for any violation of the rules, to maintain a safe and productive environment.

Modification of Agreement

If it is necessary to modify the agreement after its conclusion, the parties shall mutually adjust the agreement in consultation.

Changes in Terms and Conditions

Girls Gone Growth is entitled to amend or supplement these terms and conditions.

Customers will be notified of significant changes in advance.

Acknowledgment

By purchasing any of Girls Gone Growth’s Programs, you acknowledge that you have read, understood, and agree to these terms of service.
